Section 2 permits admission and detention for assessment, or assessment followed by initial treatment, for a maximum of 28 days. It is appropriate when the nature or degree of the mental disorder requires inpatient assessment and detention is necessary for the patient’s health or safety or the protection of others. The application is usually made by an AMHP, although the nearest relative may apply, and it must be supported by two medical recommendations. Section 3 is principally for treatment and initially lasts up to 6 months. Section 4 is an emergency admission power lasting up to 72 hours. Section 5(2) is a hospital holding power, also lasting up to 72 hours, for an existing inpatient. Section 17A provides for community treatment orders rather than admission for assessment.
