The approved mental health professional (AMHP) usually makes the formal application for detention under section 2 or section 3. The application must be supported by the required medical recommendations. Although the patient’s nearest relative may also make an application, this is not a professional role and is not an option here. The responsible clinician is responsible for aspects of a detained patient’s care, rather than ordinarily making the initial application. A second opinion appointed doctor (SOAD) provides statutory independent opinions for specified treatment decisions.
